Nevada overtime rules
- Over 40 hours in a workweek: 1.5× the regular rate.
- Over 8 hours in any 24 hour period: 1.5×, but only for employees whose regular rate is less than 1.5 times the minimum wage.
With Nevada's $12.00 minimum wage, in effect since July 1, 2024, the daily rule covers rates under $18.00 an hour. The calculator ticks the daily box for you when your rate is under $18.00; you can change it, for example if the minimum wage changes.
Exceptions
An employer and employee can agree in writing to four 10 hour days without daily overtime. Some employers and jobs are exempt, such as businesses with gross sales under $250,000 a year and certain salaried or commissioned workers.
Example
$16 an hour, four 10 hour days (40 hours). Each day has 2 daily overtime hours, so the week has 32 regular hours ($512) and 8 overtime hours at $24 ($192): $704. At $20 an hour the daily rule would not apply and the same week would have no overtime.
